Therearefewthingsthatareincapableofbeingrepresentedbyfiction。Inanimatethings,asachurch,ahospital,abridge,maybepersonatedbyarector,master,oroverseer。Butthingsinanimatecannotbeauthors,northereforegiveauthoritytotheiractors:yettheactorsmayhaveauthoritytoprocuretheirmaintenance,giventhembythosethatareownersorgovernorsofthosethings。Andthereforesuchthingscannotbepersonatedbeforetherebesomestateofcivilgovernment。

Likewisechildren,fools,andmadmenthathavenouseofreasonmaybepersonatedbyguardians,orcurators,butcanbenoauthorsduringthattimeofanyactiondonebythem,longerthan(whentheyshallrecovertheuseofreason)theyshalljudgethesamereasonable。

Yetduringthefollyhethathathrightofgoverningthemmaygiveauthoritytotheguardian。Butthisagainhasnoplacebutinastatecivil,becausebeforesuchestatethereisnodominionofpersons。

Andbecausethemultitudenaturallyisnotone,butmany,theycannotbeunderstoodforone,butinanyauthors,ofeverythingtheirrepresentativesaithordothintheirname;everymangivingtheircommonrepresenterauthorityfromhimselfinparticular,andowningalltheactionstherepresenterdoth,incasetheygivehimauthoritywithoutstint:otherwise,whentheylimithiminwhatandhowfarheshallrepresentthem,noneofthemownethmorethantheygavehimcommissiontoact。
